Terms of Service

1. The service

VisitorType (“the Service”), operated by VISITORTYPE SL, Madrid, Spain, lets you detect AI and human visitors on your websites, manage tags and triggers, and analyze traffic. By creating an account you agree to these terms.

2. Early access / free period

The Service is currently offered free of charge during early access. It is provided “as is” without warranties of any kind; features may change, and we may introduce paid plans with reasonable notice. We aim for high availability but offer no SLA during early access.

Accounts created during early access (before the announced cut-off date) may be “grandfathered” with Pro-level plan limits at no charge. This grandfathered status is a courtesy contingent on good standing and fair use: it applies to accounts that genuinely use the Service, is non-transferable, and may be modified or revoked for abuse, resale, circumvention of plan limits, or violation of these terms. Plan limits (events, containers, API keys) continue to apply to all accounts, grandfathered or not.

What “free forever” means, precisely. It is a commitment about price, not about eternity: we will not start charging a grandfathered account for the Pro-level limits it was granted, for as long as we offer the Service on those terms. It is not a guarantee that the Service, the free tier, or any specific feature will exist indefinitely, and it does not oblige us to operate the Service forever. If we ever discontinue the Service or the grandfathered tier, section 7 applies: you get advance notice and the ability to export your data — not a bill.

Because grandfathered accounts pay nothing, and to the extent permitted by law, the Service is provided to them without warranty of availability and we accept no liability for its modification or discontinuation beyond the notice commitment in section 7.

3. Your responsibilities

  • Install the snippet only on sites you own or are authorized to manage.
  • You are the data controller for your visitors: provide any legally required notices or consent mechanisms on your own sites, and use the Service in compliance with applicable law.
  • Tags you deploy through the Service are your content and your responsibility.
  • Keep your account credentials and API keys confidential.
  • No abusive use: no unlawful content in tags, no attempts to disrupt the Service, no circumventing plan limits.

4. Data

Our Privacy Policy describes what we process and how. For visitor event data we act as your processor; a data-processing agreement is available on request at [email protected]. You can delete your data by deleting containers or your account.

5. Third-party AI providers

If you connect an AI provider to the built-in assistant, your use of that provider is governed by its own terms; you are responsible for the API keys you supply and any charges they incur.

6. Liability

To the maximum extent permitted by law, the Service is provided without warranty and our total liability is limited to the amounts you paid us in the twelve months before the claim (during the free period: zero). Nothing in these terms excludes liability that cannot lawfully be excluded.

7. Termination, changes & discontinuation

You may stop using the Service and delete your account at any time. We may suspend accounts that violate these terms. We may update these terms; material changes will be announced by email or in-app with reasonable notice.

If we discontinue the Service — in whole, or a specific plan or feature — we will give you at least 30 days’ notice by email to the address on your account, and keep your data exportable throughout that period. Paid subscriptions are cancelled at that point and any prepaid, unused period is refunded pro rata; free and grandfathered accounts are not charged anything. We will not knowingly let a shutdown break your website: the snippet is designed to fail open, so if our API stops responding your pages keep working and your other tags keep firing.

If continuing to offer grandfathered terms becomes untenable— for example because of a change in law, or a change in our operating costs that makes the free tier unsustainable — we may modify those terms with the same 30 days’ notice. You will never be charged automatically as a result: if grandfathered terms change, you choose to accept a paid plan, continue on whatever free tier we offer, or export your data and leave. Nothing in this section limits any rights you have under mandatory consumer law.

8. Governing law

These terms are governed by the laws of Spain; the exclusive venue for any dispute is the courts of Madrid, Spain.
